Acknowledgment of Responsibilities

  1. Scope of Services
  • Cure & Travel acts as a facilitator, connecting Clients seeking aesthetic treatments such as hair transplants and dental procedures primarily in Istanbul, Turkey, with clinics, hospitals, and doctors. Cure & Travel may also suggest alternative countries based on the Client’s preferences. This facilitation includes, but is not limited to, providing information about potential clinics, coordinating initial consultations, assisting with scheduling, and providing pre-travel guidance.

  • Cure & Travel offers packages or tailored offers that may include hotel accommodation and transfers to/from the airport and to/from the clinic (if listed in the package). Tailored offers are customized service packages created based on the Client’s specific needs and preferences. The details of these offers, including included services and costs, will be outlined in a separate written agreement. 
  • The service is primarily limited to Istanbul, Turkey, unless otherwise agreed upon in a specific package. If a package lists another city or country, and that package is accepted by the customer then that package will define the scope of service. 
  • Services Not Included: Cure & Travel does not include flight arrangements, meals, personal expenses, insurance, after hour transfers (unless specifically arranged at a cost), or any services not explicitly listed in the agreed-upon package. 
  1. Client Responsibilities
  • Travel Arrangements: The Client is solely responsible for arranging and purchasing their own transportation, including flight tickets and other travel logistics to Turkey or any other destination. 
  • Information Accuracy: The Client must provide accurate and complete medical information, including medical history, current health status, medications, allergies, and any pre-existing conditions. The Client will complete a separate “Client Health Declaration” attesting to the accuracy of this information. 
  • Following Procedures: The Client is responsible for following all instructions and recommendations provided by the medical professionals and Cure & Travel representatives. 
  • Insurance: Cure & Travel recommends that the Client obtain travel insurance to cover unforeseen events. 
  • Payment: The Client is responsible for all payments related to the chosen package or tailored offer, including any additional expenses not covered by Cure & Travel. 
  • Client Due Diligence: The Client acknowledges their responsibility to independently verify the credentials, qualifications, and reputation of the chosen clinic, hospital, and medical professionals. Cure & Travel is not responsible for the competence or negligence of these providers. 
  • Independent Medical Advice: Cure & Travel is not a medical provider and does not offer medical advice. Clients are solely responsible for consulting with qualified medical professionals to determine the suitability of any treatment. 
  1. Cure & Travel Responsibilities
  • Facilitation: Cure & Travel will facilitate the connection between the Client and the selected medical provider. This includes, but is not limited to, providing information about potential clinics, coordinating initial consultations, assisting with scheduling, and providing pre-travel guidance. 
  • Accommodation and Transfers: Cure & Travel will arrange hotel accommodation and transfers to/from the airport and to/from the clinic, as specified in the agreed-upon package. Transfers consist of transportation in a private vehicle between the airport and hotel, and between the hotel and clinic on treatment days, as specified in the package. 
  • Information Provision: Cure & Travel will provide relevant information about the treatment process, travel arrangements, and local customs. 
  • Data Protection: Cure & Travel will handle the Client’s personal and medical information in accordance with its Privacy Policy and EU & UK GDPR regulations. 
  1. Limitation of Liability
  • The Client expressly understands and agrees that Cure & Travel by Horizonius Ltd. acts solely as a facilitator in connecting Clients with medical providers. Cure & Travel is not a medical professional and does not provide medical advice or treatment. The Client acknowledges that Cure & Travel is not responsible or liable for the outcome of any medical treatment, procedure, or advice provided by the clinics, hospitals, doctors, or other medical personnel. The Client assumes all risks associated with the chosen medical procedure, including but not limited to complications, side effects, unsatisfactory results, or death. Cure & Travel strongly recommends that the Client consult with their own physician prior to undergoing any medical procedure. 
  • To the fullest extent permitted by law, the Client hereby releases and forever discharges Cure & Travel by Horizonius Ltd., its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses arising out of or in any way connected with the Client’s medical treatment, travel arrangements, or any other services provided by third parties. 
  1. Acknowledgment of Risk
  • The Client acknowledges that all medical procedures carry inherent risks, and the outcome cannot be guaranteed. The Client has been advised to discuss these risks with the medical provider. 
  • By proceeding with the treatment, the Client accepts full responsibility for any potential adverse effects or complications. 
  1. Force Majeure
  • Cure & Travel shall not be liable for any failure to perform its obligations under this Agreement if such failure is caused by acts of God, war, terrorism, civil unrest, labor disputes, natural disasters, government regulations, or other events beyond its reasonable control.

  1. Governing Law and Dispute Resolution
  • This Acknowledgment of Responsibilities, as well as the relationship between Cure & Travel and the Client, shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. 
  • Any dispute arising out of or relating to this Acknowledgment of Responsibilities, or the breach thereof, shall be initially attempted to be resolved through good faith negotiation between the parties. If such negotiation fails, the parties agree to submit the dispute to mediation in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Rules. The mediation shall take place in London, England. 
  • If mediation is unsuccessful in resolving the dispute within [Number] days of the commencement of mediation, then either party may pursue legal action in the courts of England and Wales, which shall have exclusive jurisdiction over such dispute. 
  1. Entire Agreement and Severability
  • This Acknowledgment of Responsibilities, together with the Client Health Declaration, the Service Agreement, and any other documents expressly incorporated herein by reference, constitutes the entire agreement between Cure & Travel and the Client with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. 
  • If any provision of this Acknowledgment of Responsibilities is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of this Acknowledgment of Responsibilities will continue in full force and effect. The parties agree to negotiate in good faith to replace such invalid or unenforceable provision with a valid and enforceable provision that achieves, to the greatest extent possible, the economic, legal, and commercial objectives of the invalid or unenforceable provision.
